US based sports equipment manufacturing

A US based sports equipment manufacturing company faced accusations of patent infringement by a skate design patent holder. The patent depicted skates fashioned to resemble cars, with each foot resembling a miniature car. The skates bore resemblance to the patent which claimed priority from an application filed in the early 2000s. The sports equipment manufacturing company sought the services of Promax to challenge the validity of the patent. Initially, Promax conducted exhaustive searches across design patent databases, image repositories, historical skate product catalogs, and other relevant resources in pursuit of potential design prior art. Seeking guidance, the team consulted a senior member of the Promax team with matchless passion for cars. He mentioned a television segment from his teenage years featuring a "shoe car," which bore a striking resemblance to the disputed skate design. This revelation prompted Promax to shift their focus towards designs featuring ‘cars designed as skates or shoe’, rather than ‘skates or shoes designed as cars’. Despite initial difficulties in pinpointing relevant prior art, the team's took clues from the time frame provided by the senior. Eventually, their efforts culminated in the identification of the "Le Shoe" car, a creation of American Motors dating back to 1982, which bore remarkable similarities to the skate design in question. This discovery facilitated a successful defense against the infringement claims, ultimately leading to a settlement without the need for damages to be paid by the manufacturing company.
